Welcome to GoViral. These Terms of Service ("Terms") govern your access to and use of the GoViral platform operated by Nevira Tech LLC ("we," "us," or "our"), available at https://goviral.global.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are in the European Union, you must be at least 16 years old. By using the Service, you represent and warrant that you meet this age requirement.

2. Your Account

  • You are responsible for maintaining the confidentiality and security of your account credentials
  • You must provide accurate and complete registration information
  • You may not transfer your account to another person
  • You are responsible for all activities that occur under your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

3. User Content

3.1 Ownership

You retain ownership of content you upload to the Service. By uploading content, you grant GoViral a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, modify (for formatting and display purposes), and distribute your content in connection with operating and providing the Service.

3.2 Content Guidelines

You agree to comply with our Community Guidelines. You may NOT post content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Infringes on intellectual property rights of others
  • Contains nudity or sexually explicit material
  • Promotes violence, discrimination, or hatred
  • Is spam, deceptive, or misleading
  • Contains malware, viruses, or harmful code
  • Violates any applicable laws or regulations

3.3 AI Analysis Consent

By uploading content, you consent to our AI systems analyzing your images for the purposes of outfit deconstruction, trend scoring, style tagging, and product matching. This analysis powers core features of the Service including AURA scores and product recommendations.

3.4 Content Removal

We reserve the right to remove any content that violates these Terms or our Community Guidelines, without prior notice. We also comply with valid DMCA takedown requests — see our Copyright Policy.

4. Affiliate Links & Product Recommendations

  • GoViral earns commissions through affiliate partnerships with Amazon Associates, CJ Affiliate, and potentially other programs
  • Product recommendations are AI-generated and may include affiliate links
  • We do not guarantee product availability, pricing, or quality — these are provided by third-party retailers
  • Purchases made through affiliate links are transactions between you and the third-party retailer

5. Creator Program

GoViral offers a Creator Program that allows eligible users to earn commissions from affiliate sales generated through their content.

  • Commission Rate: 50% of the affiliate commission earned from qualifying purchases made through your content
  • Minimum Payout: $50.00 USD — payouts are processed once your balance reaches this threshold
  • Settlement Period: 60 days — commissions are held for 60 days after the qualifying purchase to account for returns and cancellations
  • Payout Method: Payments are processed through Stripe Connect; you must have a valid Stripe account
  • Tax Responsibility: You are responsible for reporting and paying applicable taxes on your earnings

We reserve the right to modify commission rates, thresholds, and settlement periods with 30 days' notice.

6. Intellectual Property

  • GoViral, the GoViral logo, and related branding are trademarks of Nevira Tech LLC
  • The Service, including its design, AI algorithms, and code, is protected by copyright and other intellectual property laws
  • You may not copy, modify, reverse-engineer, or create derivative works of any part of the Service

7. Prohibited Conduct

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to other accounts or systems
  • Use bots, scrapers, or automated tools to access the Service without permission
  • Interfere with or disrupt the Service or its infrastructure
  • Circumvent any content filtering, security measures, or rate limits
  • Impersonate any person or entity
  • Use the Service to send unsolicited communications (spam)

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, timely, or error-free
  • AI-generated recommendations or scores will be accurate
  • Affiliated products will be available or correctly priced
  • The Service will meet your specific requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEVIRA TECH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

10. Indemnification

You agree to indemnify and hold harmless Nevira Tech LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and content after a 30-day grace period
  • Any pending creator payouts below the minimum threshold may be forfeited
  • Provisions that by their nature should survive termination will survive (including Sections 6, 8, 9, 10, and 12)

12. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any disputes arising out of these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English.

13. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
